Both spouses agree to the divorce and the terms. Both are willing to sign.
Divorce is one of the most common and difficult encounters a person has with the legal system. In a contested divorce, a person can pay in excess of $15,000 or more for an attorney. However, it is possible to file a divorce without a lawyer. For a Nevada divorce, one spouse must be a Nevada resident for at least 6 weeks prior to the filing and intend on remaining in the state indefinitely. A friend, relative, or co-worker will have to sign an affidavit affirming that the spouse is indeed a resident. If you and your spouse agree on the terms of the divorce, you may file a Joint Petition. This can be filed whether you have children or not, as long as you both agree. These are typically approved very quickly and an in-person appearance with a judge is often unnecessary.
