Both spouses are willing to sign. You both have agreed on the division of the debts and assets prior to the filing so there will be no dispute as to who gets what. You have agreed on the custody, visitation and support as to the child(ren), if applicable.

Decree of Separate Maintenance is also known as a Decree of Legal Separation. This legally brings to a conclusion the community aspects of the marriage and the legal responsibilities of one party to and for the other, but you still remain married.

This is typically used for those who have beliefs that preclude divorce but would like to terminate the legal obligations to each other. 

If you decide to get married again in the future, you will need to file for divorce first. 

 

One of the spouses is not willing to sign or agree to the terms. This Complaint requires personal service on the other

party and/or publication if they are not able to be located. You are basically "suing" the other person for the separation.
